The Communiqué on the Classification of Goods and Services for Trademark Applications (TÜRKPATENT: 2024/2), published in the Official Gazette dated December 20, 2024, and numbered 32758, introduces a long-awaited update to the goods and services lists used in trademark applications. This communiqué came into effect on its publication date, and utilizing the updated lists for applications submitted after this date is crucial to avoid potential loss of rights.
The last update to the classification of goods and services was made on January 1, 2017. The newly updated list incorporates significant additions reflecting technological advancements and changes in various sectors. Key updates include:
*Artificial intelligence and humanoid robots equipped with AI,
*Cryptocurrencies and NFTs (Non-Fungible Tokens),
*Electric vehicles, including charging and rental services,
*Travel arrangements and transfer services for individuals receiving health tourism services,
*Medical masks which have become a part of daily life post-COVID.
Significance of the Update and Classification Details
This update highlights the need to align with technological advancements and evolving industry demands. However, according to Article 3, Paragraph 3 of the regulation and established case law of the Turkish Court of Cassation, the updated list does not cover all goods and services. Goods or services not included in the list may be evaluated under the same Nice class as those with similar nature, function, or purpose.
Recommendations for Applicants
Applicants who determine that their desired goods and services are not covered in the updated classification list can leverage the +99 Add Class option provided by the Turkish Patent and Trademark Office (TÜRKPATENT) to specify their unique requirements seamlessly during the application process.
