Preserving Cultural Heritage
Geographical indications and traditional specialty guaranteed marks serve as invaluable tools for preserving the unique identities and cultural heritage associated with products originating from specific regions or communities.
In Turkey, these designations are governed by the provisions outlined in the 6769 numbered Turkish Industrial Property Code, ensuring the protection of products that derive their characteristics from their geographical origins or traditional production methods.
Geographical indications denote products that have become synonymous with a particular locality, area, region, or country due to distinctive qualities, reputation, or other distinguishing features. These indications are classified as either appellations of origin or designations of origin, depending on the specific criteria outlined in the Industrial Property Code.
Appellations of origin and designations of origin are reserved for products that derive their essential characteristics from specific geographical areas, where all or most of the production, processing, and other operations take place. These designations not only protect the integrity of traditional production methods but also contribute to the economic development of local communities by promoting the unique qualities of their products.
In addition to geographical indications, traditional specialty guaranteed marks are bestowed upon products that have been traditionally used in the relevant market for at least thirty years and fulfill specific criteria outlined in the Industrial Property Code. These marks recognize the cultural significance and historical significance of products that have been cherished by consumers for generations.
We strive to provide legal services to protect geographical signs and traditional specialty guaranteed marks in Turkey. From application processes to representation before Intellectual Property Courts, the Court of Cassation/Supreme Court, and the Turkish Patent and Trademark Office (TÜRKPATENT), our team is committed to safeguarding the cultural heritage and economic interests associated with these designations.
