In our November 2018 dated article titled: “Is mediation becoming a legal obligation and/or a mandatory step in IP Infringement and other IP related cases in Turkey?” recent development regarding mediation in some IP related cases discussed. Also, in this article, the pros and cons of this institution tried to be indicated.
The stated legislative proposal (Legislative proposal number: E.2/1286) being discussed on December 06, 2018, dated the Turkish Grand National Assembly’s General Meeting and accepted. In this respect, relevant changes made in related articles enacted.
Thus, as of January 01, 2019, mediation will become a condition for litigation for IP related debt claim and compensation demands in Turkey.
