Mediation has become a condition for IP Related Litigation, Debt Claims and Compensation Cases in Turkey.

In our November 2018 article titled "Is mediation becoming a legal obligation and/or a mandatory step in IP infringement and other IP-related cases in Turkey?", we discussed the recent developments regarding mediation in certain IP-related cases. In addition, in this article, the pros and cons of this institution have been tried to be indicated.

The said bill (Bill number: E.2/1286) was discussed and adopted by the General Assembly of the Grand National Assembly of Turkey on 06 December 2018. Accordingly, the amendments made to the relevant articles became law.

Thus, as of 01 January 2019, mediation will become a condition of litigation for intellectual property receivables and compensation claims in Turkey.
